Terms of Service

These Terms of Service ("Terms") govern your use of the Trivd mobile app and the Trivd website at trivd.courtrightco.com (collectively, the "Service"), operated by Courtright Collective LLC ("we," "us," or "our"). By downloading, installing, or using Trivd, you agree to these Terms. If you don't agree, please don't use the Service.

The short version: Trivd is a trivia game for fun. Play fair, don't try to break it, and don't expect us to be liable if a question is wrong or the app crashes during a streak.

1. Who can use Trivd

You must be at least 13 years old to use Trivd. If you are under 18, you confirm that you have your parent or legal guardian's permission to use the Service. By using Trivd, you represent that you meet these requirements.

2. What Trivd is

Trivd is a free-to-play trivia game with multiple game modes (including Speed Duel, Bar Mode, Chaos Mode, and Accuracy Mode), a Daily Challenge, and a Trivia Night Generator tool. Some features are free; some, like the Trivia Night Generator beyond a free tier or removal of ads, may require payment. We may add, change, or remove features at any time without notice.

3. Your account (if you create one)

You can play Trivd without creating an account. If you choose to create one, you're responsible for keeping your credentials secure and for everything that happens under your account. Don't share your account, don't impersonate someone else, and let us know promptly if you suspect unauthorized access.

4. Acceptable use

When using Trivd, please don't:

We may suspend or terminate your access to the Service if we reasonably believe you've broken these rules.

5. Multiplayer rooms and player content

When you join a multiplayer room and choose a display name or chat with other players, please keep it civil and free of personal information. Don't use names or content that are obscene, hateful, harassing, or that contain personal data about yourself or others. We reserve the right to remove offensive content and ban players who repeatedly violate these standards.

6. Trivia content and corrections

Trivd's questions and answers are written and curated to the best of our ability, but trivia is trivia — facts change, sources disagree, and occasionally a question will be wrong or ambiguous. If you spot a question you believe is incorrect, please email us; we'll review and correct it. We do not guarantee that every question is factually accurate or appropriate for every audience.

7. Payments, subscriptions, and refunds

Some Trivd features may require payment, either as one-time purchases (e.g., the Trivia Night Generator) or as subscriptions (e.g., Trivd Pro). All prices are shown in your local currency where supported. Payments through the mobile app are processed by Apple or Google according to their terms and refund policies. Payments through our website are processed by Stripe.

Unless required by law, payments are non-refundable. For mobile app purchases, refund requests must go through Apple or Google. For website payments, contact us within 7 days of purchase and we'll consider refunds in good faith on a case-by-case basis.

8. Intellectual property

The Trivd name, logo, app code, website design, trivia content, branding, and all related materials are the property of Courtright Collective LLC. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our written permission. You may take screenshots and share gameplay clips for personal, non-commercial purposes.

9. Third-party services

Trivd uses or integrates with third-party services including Apple's App Store, Google Play, Cloudflare, and Stripe. Your use of those services is governed by their own terms. We are not responsible for the practices of third-party services.

10. Disclaimers

Trivd is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or available at all times. We do not warrant the accuracy or completeness of any trivia question or other content. We do not warrant that the app is compatible with every device, operating system, or network.

11. Limitation of liability

To the fullest extent permitted by law, Courtright Collective LLC, its members, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation lost streaks, lost in-app currency, lost data, loss of profits, or emotional distress arising from a wrong trivia answer — arising out of or related to your use of the Service.

Our total cumulative liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months prior to the event giving rise to the claim, or (b) twenty United States dollars ($20). Some jurisdictions don't allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Courtright Collective LLC from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or rights of a third party.

13. Termination

You may stop using Trivd at any time by uninstalling the app or closing your account. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we believe you've violated these Terms or otherwise put the Service or other users at risk. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time as Trivd evolves. We'll update the effective date at the top of this page when changes are made. For material changes, we'll make reasonable efforts to notify you in the app or via email. Your continued use of the Service after an update constitutes your acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of law principles. Any dispute arising out of these Terms or your use of the Service shall be brought in the state or federal courts located in Davidson County, Tennessee, and you consent to the jurisdiction of those courts. Nothing in this section limits any rights you may have under applicable consumer protection laws in your jurisdiction.

16. Apple-specific terms

If you download Trivd from Apple's App Store, you acknowledge that these Terms are between you and Courtright Collective LLC, not Apple, and that Apple is not responsible for the Service or its content. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you. You agree to use Trivd only on Apple-branded products and in accordance with Apple's Media Services Terms.

17. Google-specific terms

If you download Trivd from Google Play, you acknowledge that these Terms are between you and Courtright Collective LLC, not Google. You agree to use Trivd in accordance with the Google Play Terms of Service.

18. Entire agreement

These Terms, together with our Privacy Policy, make up the entire agreement between you and Courtright Collective LLC regarding the Service. If any part of these Terms is found to be unenforceable, the rest of the Terms remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
